Kivora Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Kivora mobile application and related services (the "App" or "Service"), operated by Mohammad Khairullahi, an individual ("Kivora," "we," "us," or "our").

By creating an account or using Kivora, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the App.

1. Eligibility

You must be 18 or older to use Kivora. If we learn an account belongs to someone under 18, we may close it. By using the App, you represent that you meet this age requirement. Kivora is not directed at, and does not knowingly permit use by, anyone under 18.

2. Your Account

  • You may create an account using Apple Sign-In, Google Sign-In, or email and password.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • You agree to provide accurate information and to keep it up to date.
  • You may delete your account at any time via Settings → Account → Delete my account, or by emailing contact@kivora.social. See our Privacy Policy for details on what happens to your data.

3. Location Services

Kivora works best with access to your device's location, which we use to recommend nearby places and experiences matching your mood. You may disable location access in your device settings; without it, some features — like nearby places and distances — are limited. Use of location services is entirely your choice and can be withdrawn at any time through your device settings.

4. Acceptable Use

When using Kivora, you agree that you will not:

  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
  • Post content that is unlawful, harassing, hateful, threatening, defamatory, obscene, or otherwise objectionable;
  • Use the App to stalk, harass, or harm another person, or to facilitate real-world harm;
  • Upload photos or content that you do not have the right to share, or that infringes another person's intellectual property or privacy rights;
  • Attempt to access another user's account without authorization;
  • Use automated means (bots, scrapers) to access or interact with the App without our written permission;
  • Interfere with or disrupt the integrity or performance of the App;
  • Use the App for any illegal purpose or in violation of any applicable law.

We reserve the right to remove content or suspend or terminate accounts that violate these Terms, at our discretion.

5. Community standards and reporting

Kivora has zero tolerance for objectionable content and abusive behavior. This includes content that is unlawful, harassing, hateful, threatening, sexually explicit, violent, fraudulent or spam, and any behavior that harms, stalks or targets other people. You can report any user, review, message, post, photo or place using the Report button, and you can block any user using the Block button. We aim to review every report within 24 hours. When we find a violation, we remove the content and may suspend or permanently remove the account, without prior notice. If you believe we made a mistake, contact contact@kivora.social.

6. User Content

  • "User Content" means any photos, captions, posts ("Picks"), messages, or other content you submit to Kivora.
  • You retain ownership of your User Content. By posting User Content, you grant Kivora a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content within the App, solely for the purpose of operating and providing the Service to you and, where you choose a public account or public-facing feature, to other users.
  • You are solely responsible for your User Content and for ensuring you have the right to post it.
  • We may remove User Content that violates these Terms or applicable law, without prior notice.
  • Public content (such as Picks shared on a public account) may remain accessible via a direct link even after later changes to your account's visibility setting, because such links point to the underlying stored file; deleting the content itself removes it.

7. Public vs. Private Accounts

You may set your account to Public (profile and Picks visible to other users) or Private (visible only to confirmed friends/connections) in Settings → Account privacy. You are responsible for choosing the setting appropriate for how you want to use the App.

8. "Talk to Kivora" and AI Features

Kivora includes an AI-powered conversational feature ("Talk to Kivora") that uses a third-party AI language model to interpret your messages and generate recommendations. Responses are generated automatically and may occasionally be inaccurate, incomplete, or not reflect real-time conditions (such as a venue's hours or availability). You should independently verify important details (hours, location, availability) directly with a venue before relying on them.

9. Third-Party Services and Content

Kivora integrates with third-party services, including Google Places (for venue information) and payment or booking links to third-party websites (such as a venue's own website or a booking platform), where applicable. We do not control and are not responsible for the accuracy, content, or practices of third-party services or websites. Your use of any third-party service is subject to that provider's own terms and privacy policy.

10. Referrals and Credits

Kivora may offer a referral program that awards in-app credits for inviting friends. Credits have no cash value, cannot be exchanged for money, and may be modified, limited, or discontinued by Kivora at any time. We reserve the right to suspend the referral program or revoke credits obtained through fraudulent or abusive activity.

11. Intellectual Property

The Kivora name, logo, App design, and underlying software are the property of Kivora and are protected by intellectual property laws. Except for the limited license to use the App as intended, these Terms do not grant you any rights to Kivora's trademarks, branding, or software.

12. Disclaimers

KIVORA IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RECOMMENDATIONS, VENUE INFORMATION, OR AI-GENERATED RESPONSES WILL BE ACCURATE OR CURRENT. YOU USE THE APP, AND ACT ON ANY RECOMMENDATION OR INFORMATION IN IT, AT YOUR OWN DISCRETION AND RISK.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KIVORA AND MOHAMMAD KHAIRULLAHI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE 12 MONTHS PRECEDING THE CLAIM.

Nothing in these Terms limits any liability that cannot be excluded or limited under applicable law, including certain consumer protection laws in your jurisdiction.

14. Indemnification

You agree to indemnify and hold harmless Kivora and Mohammad Khairullahi from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms, your User Content, or your misuse of the App.

15. Termination

We may suspend or terminate your access to Kivora at any time, with or without notice, if we believe you have violated these Terms or applicable law, or for any other reason at our discretion. You may stop using the App and delete your account at any time. Sections that by their nature should survive termination (including Sections 6, 11, 12, 13, and 14) will continue to apply.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means before the changes take effect. Continuing to use Kivora after changes take effect means you accept the revised Terms.

17. Governing Law

These Terms are governed by the laws of Brazil, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your own country or state of residence provide otherwise and cannot be waived. Any dispute arising from these Terms or the App shall first be attempted to be resolved informally by contacting contact@kivora.social.

19. Business claims

If you ask to be recognised as the owner or legal representative of a place, you confirm that the information you give is true and that you are authorised to represent that place. False or misleading claims may lead to removal of the claim, suspension of your account and, where the law allows or requires, sharing the claim records with the affected party or the authorities. We may approve or reject any claim at our discretion. Approval gives you access only to the owner tools Kivora provides; it does not give you rights over Google's place information.
